اثم المجاهير بالمعصية اعظم من المستتر بها
هل إثم المجاهر بالمعصية أعظم من إثم من يفعلها، وهو مستتر؟ وما حكم من يسمع الموسيقى بصوتٍ عالٍ بحيث يسمعها من حوله؟ وهل عليه إثم سماعها، وإثم سماع من حوله لها، وإن كانوا ينكرونها بقلوبهم؟ وهل يدخل ذلك ضمن الدعوة إلى المنكر والضلال؟
الحمد لله، والصلاة والسلام على نبينا محمد، وعلى آله، وصحبه، ومن والاه، أما بعد:
فلا شك أن المجاهر بالمعصية أعظم إثمًا من المستتر بها؛ لأن المجاهر جمع مع الوقوع في المعصية العنادَ، والاستخفافَ، قال ابن حجر في الفتح: قَالَ ابن بَطَّالٍ: فِي الْجَهْرِ بِالْمَعْصِيَةِ اسْتِخْفَافٌ بِحَقِّ اللَّهِ، وَرَسُولِهِ، وَبِصَالِحِي الْمُؤْمِنِينَ، وَفِيهِ ضَرْبٌ مِنَ الْعِنَادِ لَهُمْ، وَفِي السِّتْرِ بِهَا السَّلَامَةُ مِنَ الِاسْتِخْفَافِ؛ لِأَنَّ الْمَعَاصِيَ تُذِلُّ أَهْلَهَا، وَمِنْ إِقَامَةِ الْحَدِّ عَلَيْهِ إِنْ كَانَ فِيهِ حَدٌّ، وَمِنَ التَّعْزِيرِ إِنْ لَمْ يُوجِبْ حَدًّا، وَإِذَا تَمَحَّضَ حَقُّ اللَّهِ فَهُوَ أَكْرَمُ الْأَكْرَمِينَ، وَرَحْمَتُهُ سَبَقَتْ غَضَبَهُ، فَلِذَلِكَ إِذَا سَتَرَهُ فِي الدُّنْيَا لَمْ يَفْضَحْهُ فِي الْآخِرَةِ، وَالَّذِي يُجَاهِرُ يَفُوتُهُ جَمِيعُ ذَلِكَ.. اهـ.
وقال أيضًا: الَّذِي يُظْهِرُ الْمَعْصِيَةَ قَدِ ارْتَكَبَ مَحْذُورَيْنِ: إِظْهَارَ الْمعْصِيَة، وتلبسه بِفعل المجان. اهـ.
كما أن المجاهر أيضًا ربما أغرى الناس في الوقوع في المعصية، وحملهم على الاقتداء به فيها، قال ابن باديس -رحمه الله تعالى-: أما الذي يجاهر بمعصيته، ويعلن بها، فهذا قد تعدَّى على مجتمع الناس بما أظهر من فساد، وما أوجد من قدوة سيئة، وما عمل لمجاهرته على شيوع الفاحشة فيهم، وقد تعدى على الشرع بما انتهك من حرمته، وجرأ من السفهاء عليه، وهو بمجاهرته قد دل على استخفافه بحق الله، وحق عباده، وعلى عناده للدِّين، وخلو قلبه من الخوف، والحياء.. اهـ.
ومن جمع بين المجاهرة بسماع الموسيقى وبين إسماعها غيره، فإن عليه إثم الاستماع بنفسه، وإثم استماع غيره؛ لأنه كان سببًا في استماعهم، وقد ذكرنا في الفتويين رقم: 274672، ورقم: 213925 أنه بمنزلة الداعي إلى الضلال؛ لأنه دعا إليه بفعله.
والمروج للمنكر والقائم بنشره يحصل له وزر من عمل بهذا المنكر، كما يدل عليه حديث أَبِي هُرَيْرَةَ ـ رَضِيَ اللَّهُ عَنْهُ ـ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: مَنْ دَعَا إلَى هُدًى كَانَ لَهُ مِنْ الْأَجْرِ مِثْلُ أُجُورِ مَنْ تَبِعَهُ، لَا يَنْقُصُ ذَلِكَ مِنْ أُجُورِهِمْ شَيْئًا، وَمَنْ دَعَا إلَى ضَلَالَةٍ كَانَ عليه من الإثم مِثْلُ آثَامِ مَنْ تَبِعَهُ، لَا يَنْقُصُ ذَلِكَ مِنْ آثَامِهِمْ شيئا. رَوَاهُ مُسْلِمٌ.
والمنكرون بقلوبهم على ذلك المجاهر بالموسيقى لا إثم عليهم، بل مأجورون على إنكار القلب، إذا كانوا عاجزين عن الإنكار باليد، واللسان، وانظر للفائدة الفتوى رقم: 127016.
